Man charged for drug possession after grocery store incident

A man in West Virginia was charged for drug possession on Feb. 20 after he was found with a bag of marijuana and methamphetamine. The incident that led to the man receiving drug and other charges took place at a Sheetz store in Princeton. Deputies received a report about a man at the store who had a bag of marijuana in his pocket that was partially exposed.

When Mercer County Sheriff's Department deputies arrived at the store on Courthouse Road, the man was taken into custody. A further search was conducted later on, and the bag with the marijuana was found to contain methamphetamine as well. Deputies claim that they seized a total of 6.9 grams of methamphetamine and 142.8 grams of marijuana from the accused man.

After he was detained, the man allegedly tried to escape from the Mercer County Sheriff's Office on foot. He was unable to make it out of the building before deputies caught up with him. The man was ultimately charged for possession with intent to deliver a controlled substance, obstructing an officer and felony escape. He was held at the Southern Regional Jail with the option of $75,000 cash or surety bond.

A person who is facing drug charges after a similar incident might be able to build a solid defense by disputing the legality of the search and seizure. If deputies had no probable cause to go through a person's belongings, they may not be able to use the findings from their search as evidence in a criminal case.
